Qontigo Privacy Notice

Under this privacy notice (hereinafter the “Notice”), Qontigo GmbH (hereinafter “We” or “Us” or “Our”) informs you how We process your personal data. Your personal data means any information relating to you (hereinafter the “Personal Data”), such as name or contact details.

We pay special attention on the processing of Personal Data in accordance with the General Data Protection Regulation EU 2016/679 (“GDPR”) and applicable national data protection laws.

2. Purpose, Categories of Personal Data, Legal Basis and Retention

2.1 Categories of your Personal Data and purposes of Our processing

As a general rule, We collect your personal data directly from you.  However, We may obtain your personal data from third parties (for example cooperation partners or other members of the Deutsche Börse Group).

We process the following categories of your Personal Data for the following purposes: 

2.1.1 General contact via e-mail, postal mailing and phone

Name, address, telephone number or e-mail address if you wish to make direct contact with us. We collect your personal information when you provide it to us through our contact forms or make direct contact with us. Then we process the information that you provided us in the context of contacting. These include in particular names and submitted contact details (address, telephone number or e-mail address) date and reason for contacting. The personal information you collect will only be used to answer and fulfil your specific requests.

The legal basis is Art. 6 para. 1 lit. (f) of the GDPR, permitting the processing of Personal Data for the purposes of Our legitimate interests in processing and answering your request.

Your personal data processed in this regard will be stored by Us as long as it is necessary to carry out Our relationship (communication) with you and required by applicable statutory retention laws.

2.1.2 Press Publications, Newsletters and Publications

With your consent, you can subscribe to our Press Publications/Newsletters/Publications (together “Announcements”, which will keep you informed about new products and services, events and relevant publications.

To register for our Announcements, you will confirm the information you wish to receive. In addition, we store your IP addresses and times of registration and confirmation. The purpose of the procedure is to prove your registration and, if necessary, to inform you about possible misuse of your personal data. The legal basis is Article 6 (1) (a) and (c), Article 7 (1) GDPR.

The only requirement for sending the Announcements is your e-mail address. The specification of additional, separately marked data is voluntary and will be used to address you personally. After your confirmation, we will save your e-mail address for the purpose of sending you the Announcements. The legal basis is Art. 6 para. 1 lit. a) GDPR. Your personal data will be deleted as soon as it is no longer necessary for the purpose of its collection. The e-mail address of the user is therefore stored as long as the subscription to the Announcements is active.

You can revoke your consent to the sending of the Announcements at any time and unsubscribe from the Announcements with future effect, i.e. the withdrawal of the consent does not affect the lawfulness of processing based on the consent before its withdrawal. You can declare the revocation by clicking on the link provided in each newsletter e-mail or by sending a message to the contact details stated in the imprint. If the consent is withdrawn, We may only further process the personal data where there is another legal ground for the processing.

2.1.3 General use of Our website

When you use Our website, We will automatically log information from the browser used to access the Website, for example your, session durations, the pages that are visited from that address, and the website from where you visit the Website, if your computer is set to allow that type of collection. We may also collect device-specific information, such as your hardware model and operating system. Additionally, if you accept the use of Performance cookies (see section 5), your IP address and geo location (limited to city and Country) will be collected as well. We use this information to distinguish unique users, throttle request rates, and measure performance of our web content..

The legal basis for processing your personal data for these purposes is Art. 6 para. 1 lit. (c) of the GDPR in fulfilling Our legal obligation to implement technical and organisational measures to ensure secure data processing according to Article 32 GDPR and Article 6 para. 1. lit. (f) of the GDPR to pursue Our legitimate interests in data processing for the network and information security.

The above-mentioned data will be deleted upon the expiration of each cookie; a time period not exceed 2 years (see Section 5 for more details). To the extent that data are processed longer, we will anonymize or delete the data as soon as their storage no longer serves the respective purpose(s).

2.1.4 Marketing and Sales Activities

We may use your personal data (name, surname, address, company, phone number, email address) in order to send you information about our services, partners, promotions and events that we believe may interest you, including those of other members of the Deutsche Börse Group. We may contact you via email on the basis of our legitimate interests according to Article 6 (1) lit. f GDPR if we or another member of the Deutsche Börse Group has a direct business relationship with you or a business relationship with the company you are working for and if you have not objected. We may contact you via telephone if you have given your consent (Article 6 (1) lit. a GDPR) or based on an alleged consent on the condition that you welcome the call. We may contact you via letter based on our legitimate interests according to Article 6 (1) lit. f GDPR as long as you have not objected. Our legitimate interests in those cases are to inform business partners or potential customers about such services and products that might be of interest for them and thereby support our existing or future businesses, and the existing and future businesses of other Deutsche Börse Group members. 2.1.5 Internal and Group-Internal Administration 

We process personal data for our internal and group-internal administration, for example managing our IT, for accounting and archiving purposes and generally for our internal processes, and We may process personal data in relation with sales and purchases of assets including shares and receivables, and similar transactions.  The legal basis for processing your personal data for these purposes is Article 6 para. 1. lit. (f) of the GDPR to pursue Our legitimate interests in administering our internal and group-internal business.

2.2 Do We make automated decisions on you?

We do not make any automated decisions solely on automatic processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

3. Transfer of Personal Data to Third Parties

We will not transfer your Personal Data to third parties except such transfer is permitted by law or you have explicitly consented to the transfer. Your personal data processed in this regard will be stored by Us as long as it is necessary to carry out Our relationship (communication) with you and required by applicable statutory retention laws.

We may transfer your Personal Data to public authorities where this is required by the applicable law (e.g. the German Stock Exchange Act (Börsengesetz) or the German Securities Trading Act (Wertpapierhandelsgesetz)). A transfer of your Personal Data is also permitted if there is a suspicion of a criminal offence or the abuse of the services offered on Our website. In this event, we shall be entitled to transfer your Personal Data to the criminal prosecution authority. 

We may also share your personal data with other members of Deutsche Börse Group for legitimate interests, including for internal administrative purposes and direct marketing carried out by us or other Deutsche Börse Group members.

Otherwise, your personal data will be stored exclusively in our database and on our servers, or on those of our commissioned data processing providers. We will only share your Personal Data with other controllers for their own purposes such as cooperation or advertising partners under the condition that you explicitly and voluntarily agreed to such transfer of your Personal Data; in this case, we will obtain your consent separately from this Notice.

Sometimes the recipients to whom We transfers your personal data are located in countries in which applicable laws do not offer the same level of data protection as the laws of your home country. 

In such cases, We take measures to implement appropriate and suitable safeguards for the protection of your personal data.

Under these conditions, recipients of your personal data can be for example:

a. public bodies and institutions in the presence of a legal or regulatory obligation (eg. financial authorities),

5.1 Types of cookies

6. Use of Video-Platforms (Vimeo)

Our online platform uses embedded videos from Vimeo, a service of Vimeo, Inc. (555 West 18th Street New York, New York 10011; „Vimeo“). As soon as you visit a part of our website with an embedded video page, you will be connected to Vimeo’s servers and Vimeo will be informed on which site you are currently on. 7. Google Analytics

This website uses Google Analytics, a web analysis service offered by Google Inc. (“Google”). Google Analytics uses so-called “cookies”. These are text files that are stored on your computer and that enable the analysis of your use of the website. The information generated by the cookie about your use of the website is usually transmitted to a Google server in the USA and stored there. In case the IP anonymization function is activated on this website, the IP addresses of users within the member states of the European Union or other contracting states of the Agreement on the European Economic Area are truncated by Google beforehand. Only in exceptional cases will the full IP address be sent to a Google server in the US and truncated there. This website uses Google Analytics with the “_anonymizeIp()” extension. This truncates the IP addresses before they are further processed to rule out a direct personal reference.

We use Google Analytics to analyze the usage of our website and regularly optimize it. The statistics enable us to improve our services and make them more interesting to you as a user. For the exceptional cases in which personal data are transmitted to the US, Google is subject to the EU-US Privacy Shield. The legal basis for the use of Google Analytics is Art. 6 Para. 1 p. 1(a) of the GDPR.

8. HubSpot

With your consent, we use the services of the company HubSpot Inc. to send our newsletters and other mailings (call for papers), to administer advertising permissions and to collect statistical data on the use of our website and to optimize our offer accordingly.

Hubspot also uses so-called “cookies”, text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is transmitted to a server of Hubspot (in an EU / EEA country) and stored there. On behalf of the operator of this website, HubSpot uses this information to evaluate the use of the website by registered persons and to compile reports on website activity. 9. DoubleClick

With your consent, our website uses the online marketing tool DoubleClick by Google. DoubleClick uses cookies to serve ads that are relevant to users, to improve campaign performance reports, or to prevent a user from seeing the same ads multiple times. Google uses a cookie ID to determine which ads are shown in which browser and can prevent them from being displayed multiple times. In addition, DoubleClick uses cookie IDs to track so-called conversions related to ad requests. For example, if a user sees a DoubleClick ad and later goes to the advertiser’s website with the same browser and buys something there. Due to the marketing tools used, your browser automatically establishes a direct connection to the Google server. We have no influence on the scope and further use of the data collected by the use of this tool by Google and therefore inform you to the best of our knowledge: By including DoubleClick, Google receives the information that you access the corresponding part of our website or clicked an ad from us. If you’re registered with a service provided by Google, Google may associate the visit with your account. Even if you are not registered with Google or have not logged in, there is a chance that the provider will find and store your IP address.

Qontigo utilizes HighSpot to share documents with contacts on 1-on-1 basis. Highspot sets cookies to analyze engagement with files that are shared directly via the HighSpot platform. 11. Your Rights

Under applicable data protection laws, you have rights

  • of access to, rectification of, and/or erasure of your Personal Data;
  • to restrict or object to its processing;
  • to tell Us that you do not wish to receive marketing information; and

To the extent Our processing of your Personal Data is based on your consent, you also have the right to withdraw your consent, without affecting the lawfulness of Our processing based on your consent before its withdrawal.
